People living together best attain privacy and convenience with some mutually agreed upon understandings. We ask that you and your neighbors review and abide by the rules, regulations and procedural guidelines that are contained in your lease and this handbook. Please remember that these rules have been established for the good of all residents as a whole and are designed to help keep our communities peaceful and beautiful places you can call home.
If at any time during your residency you have questions or problems that this handbook or our leasing office has not been able to answer, please feel free to call our management office. We truly hope you will enjoy your new home.

* An infant under the age of one year (if the information is relayed to us) will not be counted as an occupant and may be renewed for an additional year. If additional occupants are added during the lease term, occupancy cannot exceed more than one occupant over the maximum occupancy limit noted above, and the resident must upgrade to a larger plan at renewal.
Please contact them if you will be out of town for any period of time, so that your mailbox does not become jammed with mail. You can also go to our website, www.LuxuryAptsWNY.com and click on "Resident Resources" to stop your mail with a few easy clicks.
Outgoing mail may be left in the office for pick up. If you receive a notice on your door about a package delivered to the office, please make arrangements to pick it up promptly or if you are expecting a package over 25 lbs., please contact the office in advance. We love assisting our residents, but have limited space. Landlord is not responsible for notification to Tenant that a package is in the Leasing office. Please note that Landlord is not responsible for loss or damage of any packages delivered to our office. If a Tenant does not pick up packages within 30 days, Landlord may return packages to sender without notification to Tenant.
Residents must pay for all utility services used in the apartment, that are not included in rent, through the last day of the term. The resident must arrange for transfer of services into their name within 72 hours of lease commencement. Failure to do so will result in a $50 per month administrative fee for each utility.
Pick your neighbors! We will pay you if you refer friends, your neighbors and coworkers! Tell your friends and family to rent with us and when they sign a one-year Lease with us you will receive CASH!
Remind those people that you refer to us to mention your name at their initial visit for this offer to apply. Call the Leasing Office for more details!
Before moving in, an inspection of the apartment should be made by you and a site representative. You will need to sign the inspection form as to the condition of the apartment. This will protect both the resident and management against improper damage charges at the time the apartment is vacated.
Moving of furniture into your unit should be scheduled between the hours of 8:00am and 5:00 pm on weekdays or Saturdays so that there will be minimum inconvenience to other residents. No moving vans are permitted late at night or on Sundays unless absolutely necessary. Vans and trucks are not allowed to drive on sidewalks or any grass areas. Residents will be responsible for charges resulting from any such damage. Please ask that your mover use care when moving your belongings through any common hallways and into your apartment. We do suggest that movers place runners on all carpeted areas to minimize damage and soiling of these areas.
Your rent is due every month on the 1st. We consider it late anytime after the 1st, however we grant a grace period until the 3rd. That means your rental account will be charged a late fee if rent is not RECEIVED by the end of the business day on the 3rd of the month. Holidays, weekends, weather conditions or your travel schedule have no effect on the due date of your rent!
You have many options when it comes to paying rent; we want to make it easy for you!
E-Check Log onto rentpayment.com and you can pay your rent via an electronic check. This is an immediate payment to us, no delivery time involved. There is a $1.00 fee for this service. While you are online you can arrange for a text message reminder to be sent to you each month!
Online Banking Many of our residents choose to set up a reoccurring payment to us through their bank. Read your banks online banking policies carefully! The date you set up to send the payment is NOT the date we will receive it! Your bank cuts a check which is mailed by regular mail, delaying our receipt by days or more...and we go by receipt date!
Automatic Withdrawal We will be happy to pull your rent from your checking account each month. Set up this automatic withdrawal by bringing a voided check to our office and filling out a simple form (the form is also available on our website!) We will pull your rent payment on time every month for you - with no service fee.
Payment by mail A paper check can be mailed to our rental office. Mail it early enough for us to receive it by the 1st! We do not look at the postmark date.
Credit Card By calling 877-927-7866 you can charge your rent to a credit card. There is a $29.95 convenience fee incurred when you use this method, (less than your late fee if you realize on the 3rd that you have forgotten to pay rent!)
We apologize, but we do not accept rent payments in the rental office. Whatever method you choose, remember... DATE RECEIVED = DATE PAID!
Service request should be made through our website www.LuxuryAptsWNY.com. If you do not have access to the internet, you may call or stop by the office during office hours to report a maintenance concern.
Please notify us promptly of any needed repairs to equipment or fixtures. When placing a work order explain the problem and service you need as clearly and completely as possible. This will help us provide better service and ensure that we fully understand the request.
Our goal is to satisfy your request within 24 hours. If this is not possible, a member of our staff will notify you as to the reason and expected date for completing the service. In some cases, a replacement part may not be available. Every effort will be made to satisfy your request as soon as possible. Because we want you to be satisfied with any service performed in your home, and your opinion matters to us, we will call you after most service requests for your comments.
In case of an emergency, call the Leasing Office immediately. If the emergency occurs after office hours, call (716) 879-0818. The maintenance staff will only return to the community, after office hours, for emergency calls only. Examples of items considered emergencies are:
No heat in winter
No electricity
Any condition that might cause a fire
Broken windows or any condition that would jeopardize security
Gas odors - please leave your home immediately and contact the gas company
Refrigeration failure
No water
A plumbing leak or sewer stoppage that may damage personal belongings or apartment property
In fairness to our maintenance staff, please use discretion when calling our answering service after hours. Unless it is an emergency, please wait until the office reopens to call in a service request.
We sincerely hope that our service request procedure will provide fast, courteous, and efficient service. If you have any questions regarding our service request policy, please contact the office.
Management works hard to keep all of our residents informed about activities and issues that affect their property, apartment, and lease. Being included on our email list will allow us to stay in contact with you and reduce wasteful paper notices posted to your door. If you have not shared your email address with us, or wish to add another email address, please visit the "Resident Resource" section of our website.
Management strongly recommends that all residents obtain a Renter’s Insurance Policy covering your personal property as your belongings are NOT covered by our insurance for any loss, including but not limited to losses, caused by fire, water damage, or theft. Links for the larger insurance companies that offer renters insurance are available at the resident resource section of our website (LuxuryAptsWNY.com).
Every Resident must sign the lease for the apartment occupied, and all such residents are both jointly and severally obligated for all conditions and terms contained in the lease and this handbook. Tenants specifically agree that notice to one Tenant constitutes due and sufficient notice to all Tenants, and that signatures and/or initials from one Tenant is considered to be acceptance and legally binding against all Tenants.
A security deposit is required on each apartment. Your deposit will be held in trust for you in an interest bearing account. Please refer to your lease for the bank your deposit is being held at.
Security deposits may NOT be used toward the last month’s rent and will be returned to your forwarding address in approximately 30 days after the final inspection of your apartment is made at the termination of the lease.
No resident may make or permit any disturbing noises by himself, his family or his guests. Loud playing of the radio, TV, stereo or other musical instruments is discouraged at any hour. Pianos and organs, because of their extreme weight, transmit sound waves through floors and walls more than any other instruments. Because of this fact, those residents who own a piano or organ will be allowed to play them only to the extent that they do not unreasonably disturb neighboring residents.
Any boisterous conduct or other actions, which will disturb the peace and quiet of the premises, are absolutely prohibited. Please consider your neighbors and the effect that your actions may have on their peace and comfort. Your consideration for your neighbors will result in their consideration of you. To report any boisterous conduct or unreasonable noise complaints, please call the local police department and then please follow-up with a phone call and written notice to the office.

We are proud to offer smoke free buildings to our residents. Specific buildings have been designated as "Smoke Free". Tenants and their guests are not allowed to smoke or use any tobacco products in these units at any time. There is also no smoking within 25 feet of a smoke free building.
Tenant agrees and acknowledges that if the apartment they occupy is in a building designated as "Smoke Free", Tenant and members of Tenant’s household shall not smoke anywhere in the Apartment or on the Patio, Balcony, or within 25 feet of a smoke free building. Tenant shall also not permit any guest or visitor under the control of the Tenant to do so
Non-Smoking buildings on each property: Autumn Creek: 15, 25, 40, 50, 70, 80, 105 and 140 Green Lake: 60, 80, townhomes 1-7 and 16-21 Renaissance: 40, 80, 85, 150, 155

Purpose of No-Smoking Policy. The parties desire to mitigate (i) the increased maintenance, cleaning and redecorating costs from smoking; (ii) the increased risk of fire from smoking; and (iii) the higher costs of fire insurance for a non-smoke-free building.
Definition of Smoking. The term "smoking" means inhaling, exhaling, breathing, or carrying any lighted cigar, cigarette, or other tobacco product or similar lighted product in any manner or in any form.
Smoke Free Building. Resident agrees and acknowledges that the Apartment to be occupied by Resident and members of resident’s household has been designated as a smoke-free living environment. Resident and members of Resident’s household shall not smoke anywhere in the Apartment or on the Patio, Balcony, or with 25 feet of a Smoke Free Building. Resident also shall not permit any guest or visitor under the control of the Resident to do so.
Resident to Promote No-Smoking Policy and to Alert Landlord of Violations. Resident shall inform Resident’s guests of the no-smoking policy. Further, Resident shall promptly give Owner a written statement of any incident where they have knowledge of the policy being violated
Owner to Promote a No-Smoking Policy. Owner shall post no-smoking signs at entrances and exits, common areas, hallways, an in conspicuous places "in close proximity to" the smoke free building.
Owner Not a Guarantor of Smoke Free Environment. Resident acknowledges that Owner’s adoption of smoke-free living environment, and the efforts to designate the premises as smoke-free, do not make the Owner or any of its managing agents the guarantor of Resident’s health or of the smoke free condition of the Resident’s Apartment and Premises. However, Owner shall use its best efforts to enforce the smoke free terms of its leases and to make the Premises smoke-free. Owner is not required to take steps in response to smoking unless Owner has actual knowledge of said smoking or has been given written notice of said smoking.
Other Resident’s are Third-Party Beneficiaries of Resident’s Agreement. Resident agrees that the other Residents of the Premises are the third-party beneficiaries of Resident’s smoke-free Lease Addendum with Owner. (In layman’s terms, this means that Resident commitments in the Lease Addendum are made to the other Residents as well as to the Owner.) A Resident may seek an injunction against another Resident to prohibit smoking or for damages, but a Resident does not have the right to evict another Resident. Any action between residents herein shall not create any presumption that the Owner breached this Lease Addendum.
Material Breach. A material breach of this Lease Addendum shall be a material breach of the Lease and grounds for immediate termination of the Lease by the Owner. Resident shall be responsible for all damages and costs associated with termination of the Lease due to material breach. Costs include a minimum charge of $1,000.00 at move out for replacement or cleaning of carpet, repainting, blinds, and smoke mitigation to remove any smoke odor or residue from the apartment. Resident understands that vacating the unit does not relieve Resident of the remaining rent and utilities due for the remainder of the Lease Term.
Disclaimer by Owner. Resident acknowledges the Owner’s adoption of a smoke-free living environment, and the efforts to designate the Premises as smoke-free does not in any way change the standard of care that the Owner or managing agent would have to a resident’s household to render buildings and premises designated as smoke-free any safer, more habitable, or improved in terms of air quality standards than any other rental premises. Owner specifically disclaims any implied or express warranties that the building, Premises, or Resident’s Apartment will have any higher or improved air quality standards than any other rental property. Owner cannot and does not warrant or promise that the premises or Apartment will be free from secondhand smoke. As this policy began April 1, 2010, there may be some Resident’s in a smoke free building that will be grandfathered in under their current lease. These Residents may be smokers and will be allowed to smoke in their unit until the end of their current Lease Term. Resident acknowledges that Owner’s ability to police, monitor, or enforce this Lease Addendum is dependent in significant part on voluntary compliance by Resident and Resident’s guests. Residents with respiratory ailments, allergies, or any other physical or mental condition relating to smoke are put on notice that Owner does not assume any higher duty of care to enforce this Lease Addendum than any of the other Owner’s obligations under the Lease.
Keys to your apartment will be issued at time of occupancy. For replacement of lost keys, a charge of $10.00 per key will apply. Alterations to or replacement of locks and installation of additional locks is not allowed without prior written consent of management. Any additional locks installed with management approval must remain on the door when the unit is vacated. The resident is required to furnish management with a key for any additional lock installed.
We do not respond to after hours lock outs for our residents due to insurance liability reasons. We suggest that you leave a spare key with a trusted neighbor, hide a spare key, or keep a spare key in your vehicle. In the event you do become locked out after office hours, please consider one of the following locksmiths that boast 24 hour emergency service with quick response time.
These companies charge between $70-$125 payable at the time of service, You are responsible for any and all charges incurred. We will be happy to assist you at no charge if you are locked out of your apartment during our regular office hours.
No painting, wallpapering or any other alterations or additions shall be done to the premises without the prior written consent of the landlord. No contact paper is permitted and bathtub, wall, or ceiling stickers may not be used.
Please do not leave shoes, boots, children’s toys or other items outside your building or apartment door. Signs of any type are not to be placed on the unit doors, in windows, or elsewhere on the community. Bicycles may NOT be kept on patios. They must be kept in a garage or storage area. Charges for damages to walls and carpeting will be billed to any resident bringing a bicycle into an apartment.
Tenant must keep the patio or balcony clean and free from snow, ice, leaves and garbage and keep all screens and drains in good repair. Tenant is responsible for and must keep the sidewalk and steps outside their private entrance door or common entry door free from snow and ice.
In line with a continuing program of beautification and landscaping of the property, cooperation in keeping lawn areas free of litter, parked bicycles, lawn chairs, picnic tables, toys and other equipment is essential.
As a courtesy to our residents who have handicap parking permits, we will install Handicap Parking signs in locations convenient to their apartment homes when requested. It is imperative that these spaces be used only by those who need them.
In an effort to keep peace and quiet as one of the many benefits of living here, management will not permit storage or operation of recreational vehicles such as mini-bikes, go-carts or snowmobiles on the premises.
No major repairs of automobiles or any other vehicles will be permitted in the parking areas or other area of the community.
Keep your vehicles locked.
Do not leave valuables in your vehicles.
Maintain a list of serial numbers of CD players, GPS units, cell phones, custom wheels, etc. and maintain proper insurance coverage on your vehicle and contents.
The community is not responsible for any theft or damage to your vehicle or its contents.
Failure to follow the parking regulations may result in towing of the vehicle at the resident’s expense. Management and Property employees are not liable for any damage that may be incurred if a vehicle needs to be towed.
Two cars per unit are allowed
Boats, trailers of any kind, campers, recreational vehicles, large trucks or buses are not permitted at anytime.
Any unlicensed, unregistered, inoperable or illegally parked vehicles will be towed at the owners’ expense. Landlord is not responsible for any damage as a result of towing.
Absolutely no parking or driving is permitted on the grass or sidewalks. The fine for doing so is $50, plus any damage repairs.
Parking is only allowed in the marked areas next to the dumpsters. Please do not park in front of the dumpsters or in the prohibited areas next to the dumpsters for the safety of your vehicle.
Motorcycles are not allowed on the grass or sidewalks at any time.
Residents are expected to move their vehicles, as needed, for snow removal.
Any resident who is expecting overnight guests for more than two days is requested to inform the office so that any necessary arrangements may be made for parking.
Any resident who will be away for a few days is requested to notify the office so that arrangements may be made to move their vehicle as needed for snow removal or paving.
Parking in unmarked areas along the driveways into the community or directly on the roadways is not allowed and the vehicle will be towed at the owner’s expense.
Residents should notify the office of any owned vehicles including the license number, model and make of the vehicle.
No paper towels, diapers or personal items are to be flushed down the toilets. No grease is to be poured down any sink but should be kept in a can and thrown away. Cat litter should not be disposed of in the toilets. If a back up occurs because of any of the aforementioned reasons, there will be a charge to the responsible party. Please remember to run COLD water before, during and after operation of the garbage disposal.
The toilets at your community comply with the New York State Environmental Conservation Law, which went into effect January 1, 1992. This law requires that all toilets installed after that date flush on 1.6 gallons of water. This change to a 1.6-gallon flush saves 54% over a 3.5-gallon toilet. That represents both a savings in water and a substantial savings in sewage treatment costs. These toilets meet Federal standards, as established by ANSI, and reflect a nationwide trend, which became Federal law January 1, 1994. As a user of this product, you must be aware of the following: The water surface area in the toilet bowl is much less which may mean you will have to clean the bowl with a brush on occasion. The trap way is also smaller which means that it is imperative that no foreign items be flushed. Any plugged toilet that requires a service call, caused by careless disposal of items, will be charged a minimum service fee of $40 per occasion. A toilet plunger has been provided to each home. Residents are expected to plunge their own toilet for minor plugs. Please attempt to plunge your own toilet before calling for maintenance.
Each unit will be equipped at time of move in with light bulbs. After move-in, each resident is expected to replace all burned-out bulbs. If you should notice any burned-out bulbs in the outdoor fixtures or common hallways, please call the Leasing Office.
Please help us keep the premises clean by using the dumpsters provided at various locations around the complex. It is imperative that all trash is wrapped or put in securely tied plastic bags before placing in trash dumpsters. No hot matches, cigarettes, cigars, ashes, charcoal, paint, flammable material, or other such substances are to be placed in the dumpster. No resident will be permitted to put trashcans or trash on the outside of the building, on patios, in hallways or outside the apartment door.
Leaving trash outside your entry or outside of the dumpsters may create a rodent problem and is unattractive to our residents. If it is determined that trash by your door or outside the dumpster is yours, we will charge $10 per bag for cleanup.
Be sure to close the covers on the dumpsters after disposing of your trash. Residents are not allowed to play in or around the dumpster enclosures.
Recycling is now law in New York. At each dumpster location, (at the back of the property at StoneGate) you will find several plastic totes. These containers are clearly marked for the recyclable items that can be disposed of in them. When disposing of corrugated cardboard boxes, they must be broken down flat and placed in the Recycling Totes.
Residents are responsible for maintaining the smoke detectors and carbon monoxide detector within their apartment including checking the operation weekly, replacing batteries when needed, and notifying the Landlord in writing by certified mail to report any problems. The smoke detectors and carbon monoxide detector are in place to protect your safety and the safety of other residents. Residents must never remove the batteries or disconnect detectors for any reason.
Do not store clothing, flammables, or cleaning fluids on the floor near the hot water tank or furnace, or on the tank or furnace! There are pilot lights for this equipment that may cause a fire hazard.
Carbon monoxide poisoning has become an increasing concern especially during the winter months. The risk of carbon monoxide poisoning increases in the winter because most apartment residents keep their windows closed and are more likely to use appliances powered by gas or kerosene, such as space heaters.
This explains what carbon monoxide is and the effects it can have on your health. It lists some common symptoms of carbon monoxide poisoning, as well as some tips on preventing a dangerous buildup of carbon monoxide in your apartment. Please read this carefully and keep it in a safe place for future reference.
What is carbon monoxide? Carbon monoxide is a colorless, odorless, and tasteless gas that’s released whenever carbon-based substances, such as natural gas or charcoal, are burned. Carbon monoxide can build up to dangerous levels if there’s no air vent or open window for it to escape from.
Effects of Carbon monoxide exposure. Your body’s red blood cells absorb carbon monoxide faster than they absorb oxygen, allowing carbon monoxide to replace the oxygen in the bloodstream – and basically suffocate tissues and organs.
Tip #1 Make sure the flue/vent of your gas fireplace is not clogged in anyway.
Tip #2 Never use charcoal, gas grills or portable generators indoors. Using a grill or generator indoors can cause a dangerous buildup of carbon monoxide.
Tip #3 Don’t use portable heaters indoors, including kerosene or gas space heaters. These are common carbon monoxide hazards as well as fire hazards. Also do not use flameless chemical heaters. Although they do not have a flame, they burn gas that could cause a buildup of carbon monoxide.
Tip #4 Don’t use gas camp stoves indoors. Using camp stoves to heat your apartment can also cause a dangerous buildup of carbon monoxide.
Tip #5 Don’t leave your car idling in a garage. The garage can quickly fill up with carbon monoxide when the door is closed. Even with the garage door open, carbon monoxide can enter your apartment if the garage is connected to your apartment.
Tip #6 Don’t block airflow around windows and doors. Don’t cover apartment windows with plastic sheeting or place rugs or towels under doors. Doing so will block the flow of fresh oxygen and prevents carbon monoxide in the apartment from escaping, even if the gas heating is working properly.
The U.S. Consumer Product Safety Commission has identified window coverings with cords as one of the top five hazards hidden in the home. Children can wrap window covering cords around their necks and become entangled in the loops. The hazards identified include: Horizontal Blinds: Blinds that do not have inner cord stop devices to prevent the inner cords from being pulled out can create a large loop that a child can become entangled in. Vertical Blinds: Strangulations can occur if a child’s neck becomes entangled on the free-standing loop formed by the bead chain or by the cord with a weighted device.
CPSC offers the following safety tips which we are eager to pass on to our residents:
In homes where young children live or visit, make sure there are no accessible looped cords within their reach.
Do not place cribs, beds, and furniture close to windows where children can climb on them to gain access to cords.
If you are concerned about any of the blinds in your home, please contact us in writing by certified mail so that we may answer any of your concerns, supply you with a safety repair kit, or take any action that may be necessary.
If there is a sprinkler head in your apartment, please notify the office in writing if there appears to be anything wrong.
Range: Your oven is self-cleaning. PLEASE DO NOT USE OVEN CLEANER IN SELF-CLEANING OVENS. If an oven cleaner is used, the special finish on the oven will be damaged and the self-cleaning feature will not work as designed. Instructions for using the self-cleaning feature are in the owner’s manual in your appliance packet, or you can call the office. Please note that the oven racks must be removed before the self-cleaning feature is used.
Refrigerator: Your refrigerator is frost-free. Do not overstuff the freezer because space is needed for air to circulate for maximum freezer usage.
Dishwasher: Use only a dishwasher detergent. Do NOT use regular soap in a dishwasher as it will over suds and cause the dishwasher to overflow.
Disposal (where available): Always run cold water when running the disposal. Never put bones or stringy substances in the disposal (celery, banana peels, sauerkraut). Also do not put any seeds, popcorn kernels, gravies, fat drippings, or potato peels in the disposal. These items will cause a paste inside the pipes and cause the drain to backup. It is a good idea to keep a disposal cover in place when not in use to ensure foreign items do not drop in the drain.
Laundry Appliances (where provided): Always remember to clean out your dryer vent after each load of laundry you dry. This is important for Fire Safety reasons! Many of our apartments have Front Load washers & dryers, please use only “he” detergent and fabric softeners in these units. They are low sudsing and will not damage the machine. Also, leave your washer door open a crack when not in use, this cuts down on getting a musty smell in your laundry room. We also ask that you refrain from running your washer and dryer after 11:00pm or before 8:00am as a courtesy to your neighbors.
Ceramic Tile: Clean with warm water and a very mild detergent
Bathtubs: Do not use "comet" or any abrasive gritty cleaner as they will damage the finish, "Soft Scrub" or a similar agent will work to remove soap buildup
Vinyl Floors: Clean with a solution of soap and water, use only water soluble, self-polishing wax
Kitchen Countertops: Clean with soap and water, do not set hot cooking pans on the counters; do not cut anything directly on the counter (use a cutting board). If you damage a countertop, the entire countertop may have to be replaced at your expense.
Air Fresheners: Plug in air fresheners are not allowed. They can be a fire hazard and certain types leak oil on the carpeting. If you damage a carpet, the entire carpet may have to be replaced at your expense.
Sorry, we don’t do windows! It is the residents’ responsibility to keep windows clean, both inside and out. Broken windows and screens will be charged to the responsible person. Please notify the office if window locks do not work properly. For security purposes, patio doors must be kept locked at all times when you are not at home.
Notify the office immediately if you have any dripping faucets (especially hot water faucets), leaking hot water tanks, running toilets or plumbing leaks. Check the temperature of your hot water; if it is too hot, please adjust the temperature on the hot water tank. If you need assistance, please notify the office.
We offer a limited cat/dog policy. Please refer to our website Pet Page for information on what is allowed at your property or speak with our leasing office. Aggressive dogs are prohibited. These breeds include but are not limited to: Pit-bulls, Chows, Rottweilers, Dobermans, Akitas, Dalmatians, Siberian Huskies, and other similar dogs known for their aggression.
Tenants that harbor pets are required to furnish a copy of their Renter’s Insurance Policy naming the landlord as an additional insured, carrying minimum liability coverage of $250,000. A Pet Addendum is required for both cats and dogs as a rider and forms a part of the Lease Agreement. Please call the office for details.
No pets are allowed, even temporarily, unless approved in writing by the Landlord. If an animal has been in a Tenant’s apartment, the Tenant will be charged a $300 fee for an unauthorized pet plus a $15 per day fee from discovery until removal of their pet.

USE OF PARK BY DOGS AND OWNERS IS AT YOUR OWN RISK
Dog Park is reserved for our small dogs (under 35 pounds) on the even hours (e.g. 2 pm – 3pm) and is reserved for larger dogs (between 36 – 100 pounds) on the odd hours (e.g. 3 pm – 4pm).
No dogs over 100 pounds are permitted in the park. The dog park is limited to no more than 6 dogs at any one time.
All dog owners and their pets are welcome to enjoy this park and to ensure that this purpose is met, please follow these guidelines and have fun!
General Guidelines
Please be a responsible dog owner and follow all posted rules and park times.
Do clean up after your pet. Violators will be fined $25 per occurrence.
Owners accompanying their pets must be 16 years of age or older.
Dog owners will be liable for the full value of any park property damaged by their dogs.
Doggie Do's
DO have a collar with proper tags showing licensing and immunization proof on your dog at all times.
DO watch and keep an eye on your dog; stay with your dog at all times.
DO everything to avoid dog fights by not bringing any food, snacks or toys into the park.
DO teach your dog to play quietly. Barking or uncontrollable dogs must be removed.
DO remove your dog immediately at the first sign of aggressive behavior toward people or other dogs.
DO leash your dog while exiting the park.
DO be sure to close all gates behind you as you enter and exit the park.
Doggie Donts
DON’T bring dogs that are sick into the park.
DON’T bring female dogs in heat into the park.
DON’T bring male dogs over 1-year-of-age that are not neutered.
DON’T let your dog dig holes that someone could trip on.
DON’T leave your dog unattended in the park.
DON’T bring children under the age of 10 into the park for their own personal safety.
DON’T bring food, snacks or toys into the park. Some dogs will attempt to protect valued resources which could result in fights.

Windsong: Card reader washers and dryers are provided in most buildings for your convenience. Please contact the Leasing Office to obtain information and a card for the Laundry Facilities. Cards can be filled in the card reader machines located in the hall near the fitness center.
Green Lake: Coin operated washers and dryers are provided in the apartment buildings for your convenience.
Do not use any tints or dyes in these machines. Always clean the lint filters in the dryers after each use. Remove your laundry promptly after the machine stops so that the next person can use them. Please report any malfuntions of the machines to the office.
Laundry room hours are from 8:00 a.m. to 10:00 p.m. To avoid disturbing other residents, the same hours should be adhered to for residents with laundry equipment in their apartments.
For residents bringing in their own laundry equipment, it is the resident's responsibility to insure that their equipment fits in the laundry area of the unit. When installing at move-in or removing the equipment at move-out, the resident is responsible for any damages including but not limited to tearing or ripping the carpet or linoleum. Only metal dryer vents should be used for connection to the vent outlet. Plastic flexible dryer hoses are a fire hazard and should never be used. It is the resident's responsibility to make sure that the hose is not kinked and/or clogged with lint. Please check the vent for lint on a regular basis to minimize the fire hazards associated with a dryer.

An adult must accompany all children using the playground for their own safety. Please make sure that there is no throwing of stones or rocks. Our toddler playground is limited to children two to seven years of age.
(does not apply to StoneGate or Green Lake)
The pool is available for use by all residents during the summer season during open pool hours. A maximum of two guests may accompany a resident to the pool. Pool hours may change due to weather conditions and discretion of management.
Use of the pool is at the sole discretion of the lifeguard on duty. A resident, over the age of 16, must accompany all children under the age of 11. The pool is only available for use when there is a lifeguard present.
The following rules & regulations must be followed when using the Pool:
Residents cannot use the pool unless lifeguard is present.
Children must be 11 years old or supervised by a person over 16 years old.
No diving.
No running, throwing objects, or horseplay.
Persons with open sores or rashes are not allowed.
Drugs, alcoholic beverages & glass containers not allowed.
No profanity or improper behavior.
No hanging on dividing rope.
No spitting, spouting water, or blowing ones nose in water.
No chewing gum allowed.
Inflatable toys, bicycles, and rollerblades are not allowed. Flotation devices may be used if a supervising adult is in the water.
All guests must wear suitable clothes for swimming (no cutoffs or jean shorts).
Pets are not allowed.

The clubhouse is available for private parties. Rental rates, rules, and regulations are available in the leasing office. Landlord will allow one complimentary use per year of our Clubhouse for our residents. Residents and their guests, under the age of 16, must be accompanied by a parent or guardian.
Please be advised that for your safety, there is a 24 hour video camera monitoring and recording activities in the clubhouse and fitness center.

Our Fitness Center is for the use of all residents who are over the age of 18 years. There is not a physical instructor employed by the Landlord and therefore we stress the following: You should consult your personal physician before using any of the equipment, especially if you are pregnant, have heart problems or have had a recent surgery or injury. The Fitness Center is open 24 hours a day, seven days a week (except for StoneGate which is open 6:00am-10:45pm, 7 days a week). Please use your fob to access the fitness room and clubhouse after office hours. Each time you enter the building, your access code and time of entry will be recorded.
In consideration of the right to use the recreational and health facilities, equipment and machinery at the community, you, your guests, and other occupants of your apartment hereby waive, release and forever discharge the community, and its owners, officers, agents, managers, employees, representatives, successors and assigns, administrators, executors and all others from any responsibility or liability from injuries or damages resulting from our use of the facilities, equipment or machinery in the above mentioned facility. You do also hereby release all of those mentioned and any others acting upon their behalf from any responsibility or liability for any injury or damage to ourselves, including those caused by the negligent act or omission of any of those mentioned or others acting on their behalf or in any way arising out of or connected with the use of any equipment or facility at the apartment community.
If a piece of equipment appears to be broken or malfunctioning, do not use and notify the management in writing so that the problem can be corrected or repaired. Management reserves the right to deny use of the facility to any resident who is delinquent in rent or has demonstrated, in the management’s opinion, a poor or dangerous use of the equipment.

Some of our communities have a "FREE" DVD and Board Game Library for the exclusive use of our residents, compliments of your management. Two DVD’s or games may be taken out at a time and returned within 48 hours. The DVD’s and Board Games are located in our leasing office for your convenience. We have all kinds of DVD’s - Action, Comedy, Drama, Horror, Classics, Westerns, and Children’s Favorites. Our selection changes monthly.
You already know that we get 40+ new movies into our office each month. Did you know that you can make requests and we’ll get your movie of choice in for you?! Let us know what you want and we’ll have it in (based on availability, of course) within 5 days!

To make our Business Center usable and enjoyable to everyone, please be advised of the following policies:
The Business Center will be open daily from 6:00am – 10:00pm
You will need to use your current key fob (specially activated by our Leasing Office) to access the business center during the above mentioned times.
No Food or Drink Allowed
No one under 16 years of age is allowed in the Business Center without parental supervision
No downloading of programs, pictures, or sound files onto the Hard Drive
No large quantity printing. Limit to 15 pages per day
The door to the business center must be closed at all times. Please do not prop open the door or let any unknown person(s) into the room
Please be respectful of other residents who are waiting to use the computers. If someone is waiting to use a machine, please limit your time to 30 minutes
No downloading or sending of inappropriate or illegal pictures, videos or files that contain pornographic material or material that may offend those around you
If any of the above policies are broken, your access to the Business Center may be terminated.

Hours for use of the Sport Court are from 9:00 AM to dusk. The Sport Court cannot be reserved, and is available on a first come, first serve basis only. The following rules & regulations must be followed when using the Sport Court:
For safety reasons, all children under 11 years or age must be supervised by a person over 16 years old. The supervising adult is responsible for the children’s safety and compliance with these rules.
Use the Sport Court at your own risk. Management is not responsible for injuries or accidents.
Sport Court hours are 9am to dusk. Do not use the Sport Court after dusk, or when surface is wet or icy.
Only residents and their guests may use the court.
Use the Sport Court equipment properly; failure to do so can result in serious injury. For example no climbing on the nets, poles, or fence.
No roughhousing, shoving or fighting. No throwing stones or any inappropriate objects. Use sport equipment for intended use only.
No roller skates, in-line skates, skateboards, bicycles or tricycles are allowed on the court.
No pets.
If you do not obey these rules, management reserves the right to stop you from using the court.
Charcoal grills, gas grills, burners and open-flame cooking devices shall not be operated on balconies, patios, and/or entryways, or within ten (10) feet of combustible construction, per New York State Fire Code (section 308.7). In addition, propane tanks cannot be stored within ten (10) feet of combustible construction which would include balconies, patios, entryways, storage units, and garages.
The storage of gas grills, burners and open-flame cooking devices on patios, balconies, and entryways within ten (10) feet of combustible construction is not allowed unless the tank is fully disconnected and removed from within then (10) feet from the building.
Charcoal grills are not permitted anywhere on the property.
If violated, all costs including but not limited to fines, penalties, legal, damages and other costs will be the responsibility of the Tenant, and considered additional rent.
An alternative that is allowed under the Fire Code would be electric grills. We strongly recommend the use of electric grills as they can be used and stored on any patio, balcony, or entryway. The management has also installed, or will be installing, charcoal grills in several areas throughout the property for the convenience of our residents. Feel free to use the grills during daylight hours. When you are done using the grill and it is cooled, please clean it.
The mini satellite dish will be no larger than eighteen inches.
The dish must be set on the patio/porch floor; it cannot be mounted to the building or railings. No drilling may be done in the siding or concrete. It must be attractively installed, so as to not distract from the apartment community appeal; this will be judged at the Landlord’s sole discretion.
Satellite dishes are only allowed on patios/porches facing away from the front driveways or roadways.
Resident accepts all liability and releases the Landlord from all claims of loss, damage or theft of the dish mountings. If any damage is caused by the dish coming free of its mountings and falling, dropping or being blown into buildings, cars or persons, the resident will be completely responsible for the repairs, liability claims, and any and all damages.
An insurance certificate naming the property as an additional insured must be provided before installing the dish.
Residents will still be held to the terms of the lease agreement whether or not resident is satisfied with the television reception of a satellite dish. Resident will not receive any reduction in rent because of the installation of a satellite dish.
If the only option is to install the dish on the roof top, attach it to the building, or install on a post in the ground, the Resident needs to receive prior written authorization from the Landlord which may be approved at Landlord’s sole option. All contractors must be approved. A $300 refundable satellite dish fee will be required for all dishes attached to the roof or any part of the building, or installed on a post in the ground prior to installation, which will be returned when the dish is removed and the roof, grounds and/or building is returned to its original condition. This deposit may be waived at the sole discretion of the Landlord depending on means of attachment.
The Landlord will remove the dish at lease termination date or move out (whichever occurs first) at resident’s expense.
Failure to comply with any of the above conditions may result in the removal of the dish by the Landlord. If the Landlord removes the dish, the Resident will be billed a minimum of $100.00 and will be responsible for any and all costs that may be incurred. The Landlord will not be responsible for any damage/loss to the Resident’s equipment or any other costs/damages that the Resident may be responsible for due to the removal of the dish.
Residents with dishes installed prior to April 11, 2005 must comply with this policy with the exception of the required $300 deposit.

Included in your monthly rental payment is basic cable service, which is active in your apartment when you move in. Simply connect your TV to an outlet via a cable wire. Your TV set may need to be “auto programmed” according to the manufacturer manual for cable reception to receive all the channels clearly. Should you experience any issue with your cable, or want to upgrade your service, please contact the cable provider and make sure you mention that your basic cable service is provided for by your landlord and included in your rent.
If a resident does not wish to renew at the end of the Lease Term, a written notice to vacate must be delivered to the Landlord on or before the first of the month, no less than 60 days prior to the end of the Lease Term. If the resident fails to give the proper 60 day written notice, or stays in the apartment after the expiration of the term without the landlord’s written consent, the landlord has the option to (1) evict the resident; or (2) declare a month-to-month term, beginning on the first day after the ending date of the original term; and the resident agrees to pay the landlord the then current monthly market rent plus $500 per month as added rent. All other provisions of the Apartment Lease will apply to the month-to-month term. After the resident has moved out of the apartment, the landlord has the right to clean, paint, decorate and then re-rent the apartment.
